Leasing a acre

I have been approached to lease 1 acre of my ground that isn't hunt able and I would not plant a food plot in this location. Too close to the road. This individual is looking for a location to plant a garden and a location to spend some time outside of the city. The reason they are interested in this location is because it has not been "farmed" in 21 year, zero animals have been raised in this area, and not chemicals have been put on this ground in at least that long. Looking to plant an "organic" garden. Currently the ground is being hayed by a local farmer. No money exchanged for the hay. The acre is part of a 12 acre parcel. I can't see it from my house or from my pond. Purchased the land 4 years ago as an investment or future location for my children!!!

I have some concerns and thoughts but I would like to hear yours!

Since you live there and can keep an eye on them, I imagine you would be okay. The people sound a little "out there" though to a country bumpkin like me, so I would take precautions -- meaning, spend the money to have a contract written up by an attorney you trust, AND make sure your liability insurance coverage is up to par.
 
Doesn't sound like it's going to put you out any. Make a rock solid contract and help someone who wants to spend some time outdoors being self productive. I kind of like the idea.
 
What is the water, electricity situation on the 1 acre? Just have the contract such that you can get out and get them out when you are ready.
Is organic marijuana legal in your area?
 
Contracts can be made well nigh bullet proof. For me it would be all about location. I have 1 acre locations on my land that I would gladly let someone get in touch with their inner farmer for a few dollars, and I have other locations that I wouldn't consider it for any money. The locations that I'd let them use would be out of sight of my operations, but along the road so I could see what they are up to, and far away from my deer bedding areas. I would only consider renting it to a total non-hunter.
 
As for the electricity and water, neither would be available. The property does have a pond but thats at the complete opposite end of the property that my family spends a fair amount of time at. So no access to the pond. Legal marijuana???? NYS changes the rules laws, daily so I am not sure but I would have none of that on my land. I don't have anything against it but just not something I care to be involved in. The location is perfect with easy access for equipment, parking and usage but the plot has thickened. Now she wants to plant trees and berry bushes and a place to park her RV for the summer. The trees???? NOPE Berry bushes???? MAYBE RV ???? ABSOLUTELY NOT!!! I am not running a KOA Camp site.
 
Planting long term perennials (that could possibly be invasives), and a camper? Getting awfully intrusive for my likes. I would become hesitant. The contract would have to be rock solid and very specific in what they can do.

A yearly fee for an RV site with water and electric in a campground is around $3000, a private site by itself out in the countryside, but no water or electric, should be worth about double that. An acre of land for a garden should be worth about $300 a month, that's year-round if berry bushes are included, so the yearly rate should be around $9600. Is it worth $10K a year to you?
 
If it was 10K a year then it would definitely be worth it to me. 10K a year I would have her park right next to the pond and would buy her a generator!!!!! But the $500 that was offered, with all of the BS, absolutely not! Thanks for the input. We will see what she "actually" wants and then I will come up with a figure?????
 
I'd deny them. Too close to the road in plain sight of the road is inviting unwanted folks to stop in and raid the garden. Fresh vegetables are pretty tempting. I'd also be concerned about the liability involved if someone got hurt on your "leased" property and if they intend to park a camper there in plain sight there's added chance of theft or vandalism. Also what are they going to do for sanitary facilities? Dump their holding tanks on the ground? Yikes. If they have kids we all know they will be exploring more than the acre they are supposed to be on.
I think you'd spend more time policing the area than it'd be worth. Once you accept a fee your liability goes to a whole new level.
If they did park a camper there how long would it be before all their friends and relatives start showing up? If you go to a lawyer to have a contract drawn up what would the charge be? Probably more than a fee for a one acre lease for many years.
Everyone wants to be a nice guy but all too often "Nice guys finish last".
 
I noticed you live in Steuben County. I used to lease a farm just outside Borden to hunt on each fall. Beautiful country down there and some nice people to boot.
 
If you bought the property as an investment. The conversation I would have is, it’s not for lease but, it is for sale.
 
I would not lease anything while an eviction moratorium is in place. Too easy for them throw up some tents or a camper on the place... For me, it just wouldn’t be worth the aggravation.... Ironclad contracts are only as good as your willingness to litigate and the ability to collect a judgment if things so south. Even then, you have to consider the bankruptcy/insolvency risk.
 
Elk, you bring up a very concerning issue that I didn't think of with the eviction moratorium!!! That is why I love this site, many opinions and everyone is looking at it from a different angle. She hasn't contacted me in a couple days so I am not sure where she stands???? But I will have to put some thought to all concerns before deciding.
